(CNN) — The murder conspiracy and racketeering trial against John “Junior” Gotti — son of the late Gambino family mob boss, John Gotti — should be moved to New York from its current location in Florida, defense attorneys argue.

“There is strong evidence to support the conclusion that the government’s decision to bring this case in Tampa is another in a string of tactical maneuvers designed to deny Gotti his right to a fair trial in what has become an epic quest to convict him,” Gotti’s attorneys wrote in a motion asking that the case be transferred from federal court in Florida’s Middle District to the Southern or Eastern District of New York.

Three previous trials of Gotti on racketeering charges ended in mistrials in New York.

A hearing was held Thursday on the motion before U.S. District Judge Steven Merryday, according to court records. Merryday took the matter under advisement and said a written ruling will be issued later.
